Terms of Service

1. Acceptance of Terms

By creating an account or using our service, you agree to be bound by these Terms. If you do not agree, you must stop using the Service immediately.

2. Age Requirement

  • You must be at least 18 years old to use FicMachine.
  • By creating an account, you represent and warrant that you meet this age requirement.
  • We reserve the right to request age verification and strictly terminate accounts found to be used by minors.

3. Your Account

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all the activity that occurs on your account.
  • You agree not to impersonate others or use names that are offensive, hate-speech related, or violate trademark rights.

4. Intellectual Property & Ownership

Your content is yours.

4.1 Your Rights

  • You own your Inputs: Any text, prompts, or scenarios you type into the Service remain your property.
  • You own your Outputs: Subject to the terms of our AI providers, we assign to you all rights, title, and interest in the text generated by the AI in response to your inputs.
  • No AI Training: We do not claim ownership of your stories, nor do we use your stories to train AI models.

4.2 Our License

In order to provide the Service (e.g., to save your story to the database, display it on your dashboard, or show it if you publish it), you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, and display your content solely for the purpose of operating the Service.

5. Third-Party IPs

  • User Responsibility: You represent that you have the necessary rights or permissions (or that your use constitutes "fair use") for any character names, settings, or trademarks you include in your prompts.
  • Indemnification: You agree to indemnify and hold us harmless from any claims resulting from your use of third-party intellectual property.

6. Acceptable Use

You agree not to use the Service to:

  • Generate Illegal Content: Including but not limited to Child Sexual Abuse Material (CSAM), non-consensual sexual content (NCSC), or real-world violence incitement.
  • Reverse Engineer: You may not attempt to scrape our API or reverse engineer our application.
  • Harassment: You may not use our service to bully, harass, or dox anyone.

7. Community & Content Moderation

  • We do not moderate private content. However, public Scenarios and Stories are subject to moderation.
  • Right to Remove: We reserve the right to remove any content that violates our Content Guidelines or these Terms.
  • Termination: We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without notice or liability, particularly for repeated violations of these Terms.

8. AI Disclaimers

  • Accuracy: Artificial Intelligence is prone to "hallucinations." The Service may generate text that is factually incorrect, nonsensical, or offensive. You use the AI at your own risk.
  • Repetition: Due to the nature of LLMs (Large Language Models), identical prompts may generate identical outputs for different users. You acknowledge that such generic outputs are not protected by exclusive copyright.

9. Subscriptions & Payments

  • Billing: Subscription fees are billed in advance on a monthly basis.
  • Rate Limits: "Unlimited" plans are subject to a Fair Use Policy. We reserve the right to throttle or temporarily suspend accounts that use automation or that impact the stability of the Service for others.

10. Limitation of Liability

To the maximum extent permitted by law, FicMachine shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data (including your stories), or goodwill, arising from your use of the Service.

Data Loss: While we use backups, you are responsible for keeping local copies of your work. We are not liable for the loss of any story drafts due to technical failure.
